We invite you to read the letter written by our directors Yoab Bitran (Compliance Group) and Ivonne Bueno (az Tech), on how organizations should prepare for the entry into force of the Personal Data Protection Law.

Mr. Director:

On January 28 we commemorate International Personal Data Protection Day and in Chile there are reasons to celebrate. The new law that modernizes the obsolete Law 19.628 was approved and its modifications will enter into force in December 2026.

This update introduces clear principles for data processing, expands the rights of data owners, toughens sanctions and incorporates a new compliance model with the figure of the Data Protection Delegate. It also creates a specialized agency with more robust supervisory and sanctioning powers than SERNAC.

However, in a country with a poor data protection culture, the compliance period is limited. To comply smoothly, organizations must act now: identify where the data are and how they are treated, design prevention programs, establish controls, define those responsible and train their teams.

Anticipation is key. Only with efficient data governance will it be possible to avoid sanctions, mitigate reputational risks and build a solid culture of information protection.
