ANCI’s activities will begin as from January 1, 2025.
On December 24, 2024, DFL N°1-21,663, dated October 30, 2024, was published in the Official Gazette, which establishes the personnel of the directors of the National Cybersecurity Agency (ANCI) and regulates other matters.
This regulation is issued in compliance with the provisions of Law No. 21,663 Framework on Cybersecurity.
On the other hand, in addition to defining the personnel, remuneration and entry requirements, among other aspects, it is especially relevant that the regulation also establishes the following:
- The date of initiation of activities of the agency is January 1, 2025.
2. In general, the entry into force of the rules of the Cybersecurity Framework Law is January 1, 2025, except for the provisions of Articles 5°, 8°, 9° and Title VII of the same law.
3. The exempted rules shall enter into force on March 1, 2025, and relate to:
- Provisions on qualification of operators of vital importance by the agency.
- Specific duties of critical operators.
- Duty to report to the National CSIRT (Computer Security Incident Response Team) cyber-attacks and cybersecurity incidents that may have significant effects.
- Infringements and sanctions contemplated in the law. Recall that penalties of up to 20 thousand UTM are established in cases of very serious infractions.
The agency will aim to lead cybersecurity policies, coordinate responses to incidents, as well as protect data and communications at all levels of the State, including the private sector and citizens to create a secure and resilient digital ecosystem.
