How to prepare my company for the new cycle of SII audits?

Apr 8, 2025

Once the tax returns stage of Operation Income Tax has concluded, a new cycle will begin to audit compliance with tax obligations.

On April 1, Operation Income Tax 2025 began, in which taxpayers must declare their income for the year 2024 before the Internal Revenue Service (SII).

In line with this approach, the SII announced this year that, once the Operation Income Tax returns stage has concluded, it will begin a new cycle of audits.

To this end, the service has broad powers to audit taxpayers’ compliance with their tax obligations.

These actions may be initiated through notifications, summonses, liquidations or other administrative acts, and may be massive, aimed at a large number of taxpayers, or selective, focused on specific economic sectors or situations with a higher risk of non-compliance.

In this context, an audit can have significant impacts if it is not approached with due preparation. Therefore, having technical and strategic advice from the early stages of the process is relevant to achieve a favorable outcome.

Some of the audits include withdrawals and dividends, the correct determination of the additional tax, returns with incomplete or inconsistent information, as well as transactions between related parties, with a special focus on transfer pricing.

Likewise, the review of large companies and multinational groups will be intensified in order to verify compliance with their tax obligations in a complete and timely manner.

In view of this scenario, az accompanies our clients in each stage of the audit process, providing comprehensive advice based on a technical and expert vision of the current regulations.

It is essential to have an exhaustive review of relevant background and documentation, the appearance and representation before the tax authority, as well as a correct preparation and presentation of responses to summons and other formal requirements.

Likewise, we recommend paying special attention to the challenge of assessments and resolutions, either through administrative appeals or judicial actions, and the defense before the Tax and Customs Courts, when the case so requires.
