We invite you to read the letter to the editor written by our Tax Group Director, Andrea Bobadilla, on the latest amendments of the Ministry of Finance to the tax compliance bill.

MR. DIRECTOR:

In relation to the last indications presented by the Ministry of Finance to the tax compliance bill, it should be noted that several of these seem to be moving in the right direction and have already been approved by the Senate Committee, highlighting some key issues related to the General Anti-Avoidance Rule (NGA) in court and the new governance of the Internal Revenue Service (SII).

In relation to the control of the NGA in court, it is assured that the application of this rule will provide legal certainty to the rights and guarantees of taxpayers, and will ensure an impartial, fair and under the standards of due process. This allows real progress to be made against evasion and avoidance, maintaining security and equity in the tax system.

The new governance of the SII is an important step forward to strengthen transparency and participation in decision making. However, it is essential that the committees do not compromise efficiency or hinder processes, so they must be oriented towards agile management, avoiding unnecessary delays and ensuring that the system operates effectively.
